A Rights-based Approach to Information in Humanitarian Assistance

This is exposing critical, unaddressed gaps in the legal and ethical frameworks that traditionally defined and governed the professional conduct of humanitarian action. The most acute of these gaps is a lack of clarity about what human rights people have regarding information in disaster, and the corresponding obligations incumbent upon governments and aid providers.  This need is lent urgency by emerging evidence demonstrating that the use of these technologies in crisis response may be, in some cases, causing harm to the very populations they intend to serve.  Preventing and mitigating these harms, while also working to responsibly ensure access to the benefits of information during crises, requires a rights-based framework to guide humanitarian operations. In this brief report, we provide a commentary that accompanies our report, the Signal Code: A Human Rights Approach to Information During Crisis, where we have identified five rights pertaining to the use of information and data during crisis which are grounded in current international human rights and customary law. Democracy Promotion: An Objective of U.S. Foreign Assistance


New Report by Congressional Research Service: “Promoting democratic institutions, processes, and values has long been a U.S. foreign policy objective, though the priority given to this objective has been inconsistent. World events, competing priorities, and political change within the United States all shape the attention and resources provided to democracy promotion efforts and influence whether such efforts focus on supporting fair elections abroad, strengthening civil society, promoting rule of law and human rights, or other aspects of democracy promotion.

Proponents of democracy promotion often assert that such efforts are essential to global development and U.S. security because stable democracies tend to have better economic growth and stronger protection of human rights, and are less likely to go to war with one another. Critics contend that U.S. relations with foreign countries should focus exclusively on U.S. interests and stability in the world order. U.S. interest in global stability, regardless of the democratic nature of national political systems, could discourage U.S. support for democratic transitions—the implementation of which is uncertain and may lead to more, rather than less, instability.

Funding for democracy promotion assistance is deeply integrated into U.S. foreign policy institutions. More than $2 billion annually has been allocated from foreign assistance funds over the past decade for democracy promotion activities managed by the State Department, the U.S. Agency for International Development, the National Endowment for Democracy, and other entities. Programs promoting good governance (characterized by participation, transparency, accountability, effectiveness, and equity), rule of law, and promotion of human rights have typically received the largest share of this funding in contrast to lower funding to promote electoral processes and political competition. In recent years, increasing restrictions imposed by some foreign governments on civil society organizations have resulted in an increased emphasis in democracy promotion assistance for strengthening civil society.

Despite bipartisan support for the general concept of democracy promotion, policy debates in the 115th Congress continue to question the consistency, effectiveness, and appropriateness of such foreign assistance. With the Trump Administration indicating that democracy and human rights might not be a top foreign policy priority, advocates in Congress may be challenged to find common ground with the Administration on this issue.

As part of its budget and oversight responsibilities, the 115th Congress may consider the impact of the Trump Administration’s requested FY2018 foreign assistance spending cuts on U.S. democracy promotion assistance, review the effectiveness of democracy promotion activities, evaluate the various channels available for democracy promotion, and consider where democracy promotion ranks among a wide range of foreign policy and budget priorities….(More)”.

The solution to US politics’ Facebook problem is Facebook


Parag Khanna in Quartz: “In just one short decade, Facebook has evolved from a fast-growing platform for sharing classmates’ memories and pet photos to being blamed for Donald Trump’s election victory, promoting hate speech, and accelerating ISIS recruitment. Clearly, Facebook has outgrown its original mission.

It should come as no surprise then that Facebook CEO Mark Zuckerberg has in the past few months issued a long manifesto explaining the company’s broader aim to foster global connectivity, given a commencement speech at Harvard focused on the need for people to feel a meaningful “sense of purpose,” as well as more recently changed the company’s mission to “give people the power to build community and bring the world closer together.”

In truth, Facebook has been doing this all along. In just a three year period between 2011-2014, the average number of international “friends” Facebook members have (whether from rich or poor countries) doubled and in many cases tripled. There is no denying that without Facebook, people would have much less exposure to people they would never meet, and therefore opportunities to gain wider perspectives (irrespective of whether they confirm or contradict one’s own). Then there are charities and NGOs from UNICEF to Human Rights Watch that raise millions of dollars on Facebook and other online platforms such as Avaaz and Change.org.

Facebook has just crossed two billion monthly users, meaning more people express their views on it each month than will vote in all elections in the world this year. That makes Facebook the largest player in wide array of social media tools that are the epicenter–and the lightening rod–for our conversation about technology and politics. Ironically, though, while so many of these innovations come out of the US, the American approach to using digital technology for better governance is at best pathetic…. Sloppy analysis, a cynical Kommentariat and an un-innovative government have led America down the path of ignoring most of the positive ways digital governance can unfold. Fortunately, there are plenty of lessons from around the world for those who care to look and learn.

Citizen engagement is an obvious start. But this should be more than just live-streamed town halls and Q&As in the run-up to elections. European governments such as the UK use Facebook pages to continuously gather policy proposals on public spending priorities. In Estonia, electronic voting is the norm. In the world’s oldest direct democracy, Switzerland, citizen petitions and initiatives are being digitized for even more transparent and inclusive deliberation. In Australia, the Flux movement is allowing all citizens to cast digital ballots on specific policy issues and submit them straight to parliament. Meanwhile, America has the Koch Brothers and the NRA…..

Even governments that are less respected in the West because their regimes do not resemble our own do a better job of harnessing social media. Sheikh Mohammed, ruler of Dubai, uses Facebook to crowdsource suggestions for infrastructure projects and other ideas from a population that is a whopping 90 percent foreign.

Singapore may be the most sophisticated government in this domain. Though the incumbent People’s Action Party (PAP) wins every parliamentary election hands-down, more important is the fact that surveys the public ad nauseam on issues of savings and healthcare, transit routes, immigration policy and just about everything else. Singapore is not Switzerland, but it might be the world’s most responsive government.

This is how governments that appear illegitimate according to a narrow reading of Western political theory boast far higher public satisfaction than most all Western governments today. If you don’t understand this, you probably spend too much time in a filter bubble….

The US should aspire to be a place where democracy and data reinforce rather than contradict each other….(More)

AI and the Law: Setting the Stage


Urs Gasser: “Lawmakers and regulators need to look at AI not as a homogenous technology, but a set of techniques and methods that will be deployed in specific and increasingly diversified applications. There is currently no generally agreed-upon definition of AI. What is important to understand from a technical perspective is that AI is not a single, homogenous technology, but a rich set of subdisciplines, methods, and tools that bring together areas such as speech recognition, computer vision, machine translation, reasoning, attention and memory, robotics and control, etc. ….

Given the breadth and scope of application, AI-based technologies are expected to trigger a myriad of legal and regulatory issues not only at the intersections of data and algorithms, but also of infrastructures and humans. …

When considering (or anticipating) possible responses by the law vis-à-vis AI innovation, it might be helpful to differentiate between application-specific and cross-cutting legal and regulatory issues. …

Information asymmetries and high degrees of uncertainty pose particular difficulty to the design of appropriate legal and regulatory responses to AI innovations — and require learning systems. AI-based applications — which are typically perceived as “black boxes” — affect a significant number of people, yet there are nonetheless relatively few people who develop and understand AI-based technologies. ….Approaches such as regulation 2.0, which relies on dynamic, real-time, and data-driven accountability models, might provide interesting starting points.

The responses to a variety of legal and regulatory issues across different areas of distributed applications will likely result in a complex set of sector-specific norms, which are likely to vary across jurisdictions….

Law and regulation may constrain behavior yet also act as enablers and levelers — and are powerful tools as we aim for the development of AI for social good. …

Law is one important approach to the governance of AI-based technologies. But lawmakers and regulators have to consider the full potential of available instruments in the governance toolbox. ….

In a world of advanced AI technologies and new governance approaches towards them, the law, the rule of law, and human rights remain critical bodies of norms. …

Advocacy and Policy Change Evaluation: Theory and Practice

Why big-data analysis of police activity is inherently biased


 and  in The Conversation: “In early 2017, Chicago Mayor Rahm Emanuel announced a new initiative in the city’s ongoing battle with violent crime. The most common solutions to this sort of problem involve hiring more police officers or working more closely with community members. But Emanuel declared that the Chicago Police Department would expand its use of software, enabling what is called “predictive policing,” particularly in neighborhoods on the city’s south side.

The Chicago police will use data and computer analysis to identify neighborhoods that are more likely to experience violent crime, assigning additional police patrols in those areas. In addition, the software will identify individual people who are expected to become – but have yet to be – victims or perpetrators of violent crimes. Officers may even be assigned to visit those people to warn them against committing a violent crime.

Any attempt to curb the alarming rate of homicides in Chicago is laudable. But the city’s new effort seems to ignore evidence, including recent research from members of our policing study team at the Human Rights Data Analysis Group, that predictive policing tools reinforce, rather than reimagine, existing police practices. Their expanded use could lead to further targeting of communities or people of color.

Working with available data

At its core, any predictive model or algorithm is a combination of data and a statistical process that seeks to identify patterns in the numbers. This can include looking at police data in hopes of learning about crime trends or recidivism. But a useful outcome depends not only on good mathematical analysis: It also needs good data. That’s where predictive policing often falls short.

Machine-learning algorithms learn to make predictions by analyzing patterns in an initial training data set and then look for similar patterns in new data as they come in. If they learn the wrong signals from the data, the subsequent analysis will be lacking.

This happened with a Google initiative called “Flu Trends,” which was launched in 2008 in hopes of using information about people’s online searches to spot disease outbreaks. Google’s systems would monitor users’ searches and identify locations where many people were researching various flu symptoms. In those places, the program would alert public health authorities that more people were about to come down with the flu.

But the project failed to account for the potential for periodic changes in Google’s own search algorithm. In an early 2012 update, Google modified its search tool to suggest a diagnosis when users searched for terms like “cough” or “fever.” On its own, this change increased the number of searches for flu-related terms. But Google Flu Trends interpreted the data as predicting a flu outbreak twice as big as federal public health officials expected and far larger than what actually happened.

Criminal justice data are biased

The failure of the Google Flu Trends system was a result of one kind of flawed data – information biased by factors other than what was being measured. It’s much harder to identify bias in criminal justice prediction models. In part, this is because police data aren’t collected uniformly, and in part it’s because what data police track reflect longstanding institutional biases along income, race and gender lines….(More)”.

Can blockchain technology help poor people around the world?

That makes it safe and affordable for a person to store any amount of money securely and confidently. While that’s still in the future, blockchain-based systems are already helping people in the developing world in very real ways.

Sending money internationally

In 2016, emigrants working abroad sent an estimated US$442 billion to their families in their home countries. This global flow of cash is a significant factor in the financial well-being of families and societies in developing nations. But the process of sending money can be extremely expensive….Hong Kong’s blockchain-enabled Bitspark has transaction costs so low it charges a flat HK$15 for remittances of less than HK$1,200 (about $2 in U.S. currency for transactions less than $150) and 1 percent for larger amounts. Using the secure digital connections of a blockchain system lets the company bypass existing banking networks and traditional remittance systems.

Similar services helping people send money to the Philippines, Ghana, Zimbabwe, Uganda, Sierra Leone and Rwanda also charge a fraction of the current banking rates.

Insurance

Most people in the developing world lack health and life insurance, primarily because it’s so expensive compared to income. Some of that is because of high administrative costs: For every dollar of insurance premium collected, administrative costs amounted to $0.28 in Brazil, $0.54 in Costa Rica, $0.47 in Mexico and $1.80 in the Philippines. And many people who live on less than a dollar a day have neither the ability to afford any insurance, nor any company offering them services….Consuelo is a blockchain-based microinsurance service backed by Mexican mobile payments company Saldo.mx. Customers can pay small amounts for health and life insurance, with claims verified electronically and paid quickly.

Helping small businesses

Blockchain systems can also help very small businesses, which are often short of cash and also find it expensive – if not impossible – to borrow money. For instance, after delivering medicine to hospitals, small drug retailers in China often wait up to 90 days to get paid. But to stay afloat, these companies need cash. They rely on intermediaries that pay immediately, but don’t pay in full. A $100 invoice to a hospital might be worth $90 right away – and the intermediary would collect the $100 when it was finally paid….

Humanitarian aid

Blockchain technology can also improve humanitarian assistance. Fraud, corruption, discrimination and mismanagement block some money intended to reduce poverty and improve education and health care from actually helping people.In early 2017 the U.N. World Food Program launched the first stage of what it calls “Building Block,” giving food and cash assistance to needy families in Pakistan’s Sindh province. An internet-connected smartphone authenticated and recorded payments from the U.N. agency to food vendors, ensuring the recipients got help, the merchants got paid and the agency didn’t lose track of its money.

…In the future, blockchain-based projects can help people and governments in other ways, too. As many as 1.5 billion people – 20 percent of the world’s population – don’t have any documents that can verify their identity. That limits their ability to use banks, but also can bar their way when trying to access basic human rights like voting, getting health care, going to school and traveling.

Introduction

In 2008, an unknown source calling itself Satoshi Nakamoto released a paper named Bitcoin: A Peer-to-Peer Electronic Cash System which introduced blockchain technology. Blockchain is a novel system that uses a distributed ledger to record transactions and ensure compliance. Blockchain technology relies on an ability to act as a vast, transparent, and secure public database.

It has since gained recognition as a tool to transform governance by creating a decentralized system to

  • manage and protect identity,
  • trace and track; and
  • incentivize smarter social and business contracts.

These applications cast blockchain as a tool to confront certain public problems in the digital age.

  • An essay arguing that blockchain is useful outside of financial institutions for government agencies, particularly those that store sensitive information such as birth and death dates or information about marital status, business licensing, property transfers, and criminal activity.
  • Blockchain technology would maintain the security of such sensitive information while also making it easier for agencies to use and access critical public-sector information.
  • Despite its potential, a significant drawback for use by government agencies is the speed with which blockchain has developed – there are no accepted standards for blockchain technologies or the networks that operate them; and because many providers are start-ups, agencies might struggle to find partners that will have lasting power. Additionally, government agencies will have to remain vigilant to ensure the security of data.

  • The authors compare the emergence of blockchain to other technologies that have had transformative power, such as TCP/IP, and consider the speed with which they have proliferated and become mainstream.
    • They argue that like TCP/IP, blockchain is likely decades away from maximizing its potential and offer frameworks for the adoption of the technology involving both single-use, localization, substitution, and transformation.

  • This technical paper suggests that anonymization and centralized systems can never provide complete security for personal data, and only blockchain technology, by creating a decentralized data management system, can overcome these privacy issues.
  • The authors identify 3 common privacy concerns that blockchain technology can address:
    • Data ownership: users want to own and control their personal data, and data management systems must acknowledge this.
    • Data transparency and auditability: users want to know what data is been collected and for what purpose.
    • Fine-grained access control: users want to be able to easily update and adapt their permission settings to control how and when third-party organizations access their data.
  • The authors propose their own system designed for mobile phones which integrates blockchain technology to store data in a reliable way. The entire system uses blockchain to store data, verify users through a digital signature when they want to access data, and creates a user interface that individuals  can access to view their personal data.
  • Though much of the body of this paper includes technical details on the setup of this blockchain data management system, it provides a strong case for how blockchain technology can be practically implemented to assuage privacy concerns among the public. The authors highlight that by using blockchain “laws and regulations could be programmed into the blockchain itself, so that they are enforced automatically.” They ultimately conclude that using blockchain in such a data protection system such as the one they propose is easier, safer, and more accountable.

  • This paper proposes that the emergence of blockchain technology, and its various applications (decentralized currencies, self-executing contracts, smart property etc.), will necessitate the creation of a new subset of laws, termed by the authors as “Lex Cryptographia.”
  • Considering the ability for blockchain to “cut out the middleman” there exist concrete challenges to law enforcement faced by the coming digital revolution brought by the technology. These encompass the very benefits of blockchain; for instance, the authors posit that the decentralized, autonomous nature of blockchain systems can act much like “a biological virus or an uncontrollable force of nature” if the system was ill-intentioned. Though this same system can regulate the problems of corruption and hierarchy associated with traditional, centralized systems, their autonomy poses an obvious obstacle for law-enforcement.
  • The paper goes on to details all the possible benefits and societal impacts of various applications of blockchain, finally suggesting there exists a need to “rethink” traditional models of regulating society and individuals. They predict a rise in Lex Cryptographia “characterized by a set of rules administered through self-executing smart contracts and decentralized (and potentially autonomous) organizations.” Much of these regulations depend upon the need to supervise restrictions placed upon blockchain technology that may chill its application, for instance corporations who may choose to purposefully avoid including any blockchain-based applications in their search engines so as to stymie the adoption of this technology.

Big Data for Achievement of the 2030 Agenda: Data Privacy, Ethics and Protection


UNDG Guidance Note: “This document sets out general guidance on data privacy, data protection and data ethics for the United Nations Development Group (UNDG) concerning the use of big data, collected in real time by private sector entities as part of their business offerings1 , and shared with UNDG members for the purposes of strengthening operational implementation of their programmes to support the achievement of the 2030 Agenda.

The Guidance Note is designed to:

• Establish common principles across UNDG to support the operational use of big data for achievement of the Sustainable Development Goals (SDGs);

• Serve as a risk-management tool taking into account fundamental human rights; and

• Set principles for obtaining, retention, use and quality control for data from the private sector. The data revolution was recognized as an enabler of the Sustainable Development Goals, not only to monitor progress but also to inclusively engage stakeholders at all levels to advance evidence-based policies and programmes and to reach the most vulnerable.

The 2030 Agenda asserts that “Quality, accessible, timely and reliable disaggregates data will be needed to help with the measurement of progress (SGDs) and to ensure that no one is left behind. Such data is key to decision making.” At the same time, there are legitimate concerns regarding risks associated with handling and processing of big data, particularly in light of the current fragmented regulatory landscape and in the absence of a common set of principles on data privacy, ethics and protection. These concerns continue to complicate efforts to develop standardized and scalable approaches to risk management and data access. A coordinated approach is required to ensure the emergence of frameworks for safe and responsible use of big data for the achievement of the 2030 Agenda.
