Behavioral Analysis of International Law: On Lawmaking and Nudging


Article by Doron Teichman and Eyal Zamir: “… examines the application of insights from behavioral economics to the area of international law. It reviews the unique challenges facing such application and demonstrates the contribution of behavioral findings to the understanding of lawmaking, the use of nudges, and states’ practices in the international arena.

In the sphere of lawmaking, the article first highlights the contribution of experimental game theory to understanding international customary law. It then analyzes the psychological mechanisms underpinning the advancement of treaty law through the use of deadlines, grandfather provisions, deferred implementation, and temporary arrangements. More generally, it provides insight into the processes through which international soft law evolves into hard law.

The article then argues that in the absence of a central legislative body or strong enforcement mechanisms, nudges (that is, low-cost, choice-preserving, behaviorally informed regulatory tools) can play a particularly important role in influencing the behavior of states and other entities. The article describes the current use of nudges, such as opt-in and opt-out arrangements in multilateral treaties, goal settings, and international rankings—and calls for further employment of such means.

Nudge Units to Improve the Delivery of Health Care


Mitesh S. Patel et al in The New England Journal of Medicine: “The final common pathway for the application of nearly every advance in medicine is human behavior. No matter how effective a drug, how protective a vaccine, or how targeted a therapy may be, a clinician usually has to prescribe it, and a patient accept and use it as directed, for it to improve health. Clinicians’ and patients’ environments influence their decisions about taking these actions, and the seemingly subtle design of information and choices can have outsize effects on our behavior. When the “choice architecture” is designed to influence behavior in a predictable way but without restricting choice, it is often called a “nudge.”…

In 2016, we launched the Penn Medicine Nudge Unit to systematically develop and test approaches using nudges to improve health care delivery. The goals are to improve health care value and outcomes, advance knowledge about how to best implement nudges for impact, evaluate our efforts, and disseminate our findings. Ideas are generated by health system leadership, frontline clinicians and staff, and members of the unit itself. Our early successes and failures reveal some lessons about the role that nudge units can play in improving health care (see table).

First, these units can help health systems understand when it makes sense to use a nudge and when it doesn’t. Nudges can be designed to remind, guide, or motivate behavior. Promising opportunities are those in which suboptimal care can be addressed by targeting a specific decision that drives a less-than-optimal behavior. For example, when prescribing medications, physicians must decide between brand-name and generic formulations. Systems can set generics as the default choice, so that ordering them becomes the path of least resistance even as the ability to opt out and order a brand-name drug is preserved. When we implemented this change in our EHR, prescribing rates for generics increased from 75% to 98%. Clinical settings also play an important role. We found that reducing the default duration of opioid prescriptions may make sense for acute conditions often seen by clinicians in the emergency department but may be inappropriate for clinicians caring for patients with chronic pain.

Second, although nudges have typically been deployed for simple one-off decisions, we’ve found that they can also support more complex decision paths. For example, only 15% of our eligible patients were being referred for cardiac rehabilitation after myocardial infarction. When we asked the cardiologists why, we discovered that the process remained manual, so they had to take action to initiate the referrals — in other words, it was an opt-in system. The process was redesigned as an opt-out system in which referral for rehab was the default; patient identification was automated using the EHR; staff were notified using secure text messaging; and processes were restructured so that cardiologists signed orders in a template for referral on rounds and staff met with patients to set up rehab placement before discharge. The referral rate increased to more than 80%.

The Potential for Human-Computer Interaction and Behavioral Science

A few days ago, one of my best friends texted me a joke. It was funny, so a few seconds later I replied with the “laughing-while-crying emoji.” A little yellow smiley face with tear drops perched on its eyes captured exactly what I wanted to convey to my friend. No words needed. If this exchange happened ten years ago, we would have emailed each other. Two decades ago, snail mail.

As more of our interactions and experiences are mediated by screens and technology, the way we relate to one another and our world is changing. Posting your favorite emoji may seem superficial, but such reflexes are becoming critical for understanding humanity in the 21st century.

Seemingly ubiquitous computer interfaces—on our phones and laptops, not to mention our cars, coffee makers, thermostats, and washing machines—are blurring the lines between our connected and our unconnected selves. And it’s these relationships, between users and their computers, which define the field of human–computer interaction (HCI). HCI is based on the following premise: The more we understand about human behavior, the better we can design computer interfaces that suit people’s needs.

For instance, HCI researchers are designing tactile emoticons embedded in the Braille system for individuals with visual impairments. They’re also creating smartphones that can almost read your mind—predicting when and where your finger is about to touch them next.

Understanding human behavior is essential for designing human-computer interfaces. But there’s more to it than that: Understanding how people interact with computer interfaces can help us understand human behavior in general.

One of the insights that propelled behavioral science into the DNA of so many disciplines was the idea that we are not fully rational: We procrastinate, forget, break our promises, and change our minds. What most behavioral scientists might not realize is that as they transcended rationality, rational models found a new home in artificial intelligence. Much of A.I. is based on the familiar rational theories that dominated the field of economics prior to the rise of behavioral economics. However, one way to better understand how to apply A.I. in high-stakes scenarios, like self-driving cars, may be to embrace ways of thinking that are less rational.

It’s time for information and computer science to join forces with behavioral science. The mere presence of a camera phone can alter our cognition even when switched off, so if we ignore HCI in behavioral research in a world of constant clicks, avatars, emojis, and now animojis we limit our understanding of human behavior.

Sharing is Daring: An Experiment on Consent, Chilling Effects and a Salient Privacy Nudge


Hermstrüwer, Yoan and Dickert, Stephan at the International Review of Law and Economics: “Privacy law rests on the assumption that government surveillance may increase the general level of conformity and thus generate a chilling effect. In a study that combines elements of a lab and a field experiment, we show that salient and incentivized consent options are sufficient to trigger this behavioral effect. Salient ex ante consent options may lure people into giving up their privacy and increase their compliance with social norms – even when the only immediate risk of sharing information is mere publicity on a Google website. A right to be forgotten (right to deletion), however, seems to reduce neither privacy valuations nor chilling effects. In spite of low deletion costs people tend to stick with a retention default. The study suggests that consent architectures may play out on social conformity rather than on consent choices and privacy valuations. Salient notice and consent options may not merely empower users to make an informed consent decision. Instead, they can trigger the very effects that privacy law intends to curb….(More)”.

The Challenge of VR to the Liberal Democratic Order

Andy Hagerman at Stanford Social Innovation Review: “Design thinking: It started as an academic theory in the 60’s, a notion of starting to look at broader types of challenges with the intention and creativity that designers use to tackle their work. It gained widespread traction as a product design process, has been integrated into culture change initiatives of some of the world’s most important organizations and governments, and has been taught in schools kindergarten to grad school. It’s been celebrated, criticized, merged with other methodologies, and modified for nearly every conceivable niche.

Regardless of what side of those perspectives you fall on, it’s undeniable that design thinking is continuing to grow and evolve. Looking across the social innovation landscape today, we see a few patterns that, taken together, suggest that social innovators continue to see great promise in design thinking. They are working to find ways to make it yield real performance gains for their organizations and clients.

From design thinking to design doing

Creative leaders have moved beyond increasing people’s awareness of design thinking to actively seeking concrete opportunities for using it. One of the principal drivers of this shift has been the need to demonstrate value and return on investment from design-thinking initiatives—something people have talked about for years. (Ever heard the question, “Is design thinking just the next fad?”) Social sector organizations, in particular, stand to benefit from the shift from design thinking to design doing. Timelines for getting things built in the social sector are often slow, due to legitimate constraints of responsibly doing impact work, as well as to legacy practices and politics. As long as organizations use design thinking responsibly and acknowledge the broader systems in which new ideas live, some of the emerging models can help them move projects along more quickly and gain greater stakeholder participation….

Building cultures around design thinking

As design thinking has proliferated, many organizational leaders have moved from replicating the design thinking programs of academic institutions like the Stanford d.School or foundational agencies like IDEO to adapting the methodology to their own goals, external environments, and organizational cultures.

One organization that has particularly inspired us is Beespace, a New York City-based social-impact foundation. Beespace has designed a two-year program that helps new organizations not only get off the ground, but also create the conditions for breakthrough innovation. To create this program, which combines deep thinking, impact assessment, and rapid prototyping, Beespace’s leadership asked itself what tools it would need, and came up with a mix that included not just design thinking, but also disciplines of behavioral science and systems thinking, and tools stemming from emotional intelligence and theory of change….

We have seen a lot of interest this year in “train the trainer” programs, particularly from organizations realizing the value of developing their internal capabilities to reduce reliance on outside consultants. Such development often entails focusing on the few people in the organization who are highly capable of instigating major change, as opposed to spreading awareness among the many. “Nudge units” – where they came from and what they can do


Zeina Afif at the Worldbank: “You could say that the first one began in 2009, when the US government recruited Cass Sunstein to head The Office of Information and Regulatory Affairs (OIRA) to streamline regulations. In 2010, the UK established the first Behavioural Insights Unit (BIT) on a trial basis, under the Cabinet Office. Other countries followed suit, including the US, Australia, Canada, Netherlands, and Germany. Shortly after, countries such as India, Indonesia, Peru, Singapore, and many others started exploring the application of behavioral insights to their policies and programs. International institutions such as the World Bank, UN agencies, OECD, and EU have also established behavioral insights units to support their programs. And just this month, the Sustainable Energy Authority of Ireland launched its own Behavioral Economics Unit.

The Future
As eMBeD, the behavioral science unit at the World Bank, continues to support governments across the globe in the implementation of their units, here are some common questions we often get asked.

What are the models for a Behavioral Insights Unit in Government?
As of today, over a dozen countries have integrated behavioral insights with their operations. While there is not one model to prescribe, the setup varies from centralized or decentralized to networked….

In some countries, the units were first established at the ministerial level. One example is MineduLab in Peru, which was set up with eMBeD’s help. The unit works as an innovation lab, testing rigorous and leading research in education and behavioral science to address issues such as teacher absenteeism and motivation, parents’ engagement, and student performance….

What should be the structure of the team?
Most units start with two to four full-time staff. Profiles include policy advisors, social psychologists, experimental economists, and behavioral scientists. Experience in the public sector is essential to navigate the government and build support. It is also important to have staff familiar with designing and running experiments. Other important skills include psychology, social psychology, anthropology, design thinking, and marketing. While these skills are not always readily available in the public sector, it is important to note that all behavioral insights units partnered with academics and experts in the field.

The U.S. team, originally called the Social and Behavioral Sciences Team, is staffed mostly by seconded academic faculty, researchers, and other departmental staff. A Systematic Scoping Review of the Choice Architecture Movement: Towards Understanding When and Why Nudges Work


Barnabas Imre Szaszi et al in the Journal of Behavioral Decision Making: “In this paper, we provide a domain-general scoping review of the nudge movement by reviewing 422 choice architecture interventions in 156 empirical studies. We report the distribution of the studies across countries, years, domains, subdomains of applicability, intervention types, and the moderators associated with each intervention category to review the current state of the nudge movement. Furthermore, we highlight certain characteristics of the studies and experimental and reporting practices which can hinder the accumulation of evidence in the field. Specifically, we found that 74 % of the studies were mainly motivated to assess the effectiveness of the interventions in one specific setting, while only 24% of the studies focused on the exploration of moderators or underlying processes. We also observed that only 7% of the studies applied power analysis, 2% used guidelines aiming to improve the quality of reporting, no study in our database was preregistered, and the used intervention nomenclatures were non-exhaustive and often have overlapping categories. This Essay argues that the remarkable success of nudges as a species creates new challenges and opportunities for individual nudges that did not exist ten years ago, when nudges were new. These changes follow from the new fact that nudges must now interact with other nudges. This creates opportunities for nudge versus nudge battles, where nudges compete with other nudges for the scarce resource of public cognition; and for nudge & nudge symbiosis, where nudges work complementarily with other nudges to achieve greater good with fewer resources. Because of the potential for positive and negative interactions with other nudges, modern nudges should be expected to operate differently from ancestral nudges in important ways, and future nudges should be expected to operate more differently still.
