Please find below the latest installment in The GovLab Index series, inspired by the Harper’s Index. “The GovLab Index: Designing for Behavior Change” explores the recent application of psychology and behavioral economics towards solving social issues and shaping public policy and programs.   • Elderly Americans are asked to choose from over 40 options when enrolling in Medicaid Part D private drug plans. How many switched plans to save money when they received a letter providing information about three plans that would be cheaper for them: almost double 
    • The amount saved on average per person by switching plans due to this intervention: $150 per year
  • Increase in prescriptions to manage cardiac disease when Medicaid enrollees are sent a suite of behavioral nudges such as more salient description of the consequences of remaining untreated and post-it note reminders during an experiment in the U.S.: 78%

Big Data for Law


legislation.gov.uk: “The National Archives has received ‘big data’ funding from the Arts and Humanities Research Council (AHRC) to deliver the ‘Big Data for Law‘ project. Just over £550,000 will enable the project to transform how we understand and use current legislation, delivering a new service – legislation.gov.uk Research – by March 2015. There are an estimated 50 million words in the statute book, with 100,000 words added or changed every month. Search engines and services like legislation.gov.uk have transformed access to legislation. Law is accessed by a much wider group of people, the majority of whom are typically not legally trained or qualified. All users of legislation are confronted by the volume of legislation, its piecemeal structure, frequent amendments, and the interaction of the statute book with common law and European law. Not surprisingly, many find the law difficult to understand and comply with. There has never been a more relevant time for research into the architecture and content of law, the language used in legislation and how, through interpretation by the courts, it is given effect. Research that will underpin the drive to deliver good, clear and effective law. Researchers typically lack the raw data, the tools, and the methods to undertake research across the whole statute book. Meanwhile, the combination of low cost cloud computing, open source software and new methods of data analysis – the enablers of the big data revolution – are transforming research in other fields. Big data research is perfectly possible with legislation if only the basic ingredients – the data, the tools and some tried and trusted methods – were as readily available as the computing power and the storage. The vision for this project is to address that gap by providing a new Legislation Data Research Infrastructure at research.legislation.gov.uk. Specifically tailored to researchers’ needs, it will consist of downloadable data, online tools for end-users; and open source tools for researchers to download, adapt and use….
There are three main areas for research:

  • Understanding researchers’ needs: to ensure the service is based on evidenced need, capabilities and limitations, putting big data technologies in the hands of non-technical researchers for the first time.
  • Deriving new open data from closed data: no one has all the data that researchers might find useful. For example, the potentially personally identifiable data about users and usage of legislation.gov.uk cannot be made available as open data but is perfect for processing using existing big data tools; eg to identify clusters in legislation or “recommendations” datasets of “people who read Act A or B also looked at Act Y or Z”. The project will look whether it is possible to create new open data sets from this type of closed data. An N-Grams dataset and appropriate user interface for legislation or related case law, for example, would contain sequences of words/phrases/statistics about their frequency of occurrence per document. N-Grams are useful for research in linguistics or history, and could be used to provide a predictive text feature in a drafting tool for legislation.
  • Pattern language for legislation: We need new ways of codifying and modelling the architecture of the statute book to make it easier to research its entirety using big data technologies. The project will seek to learn from other disciplines, applying the concept of a ‘pattern language’ to legislation. Pattern languages have revolutionised software engineering over the last twenty years and have the potential to do the same for our understanding of the statute book. A pattern language is simply a structured method of describing good design practices, providing a common vocabulary between users and specialists, structured around problems or issues, with a solution. Patterns are not created or invented – they are identified as ‘good design’ based on evidence about how useful and effective they are. Applied to legislation, this might lead to a common vocabulary between the users of legislation and legislative drafters, to identifying useful and effective drafting practices and solutions that deliver good law. This could enable a radically different approach to structuring teaching materials or guidance for legislators.”

Habermas and the Garants : Narrowing the gap between policy and practice in French organisation – citizen engagement


New paper by Judy Burnside-Lawry, Carolyne Lee and Sandrine Rui: “This article draws on a case study of organisation–citizen engagement during railway infrastructure planning in southwest France, to examine the nature of participatory democracy, both conceptually —as elucidated by Habermas and others— and empirically, as recently practised within the framework of a model established in one democratically governed country.
We analyse roles played by the state organisation responsible for building railway infrastructure; the National Commission for Public Debate; and the Garants, who oversee and facilitate the participatory process as laid down by the French law of Public Debate. We conclude by arguing that despite its normative aspects and its lack of provision for analysis of power relations, Habermas’s theory of communicative action can be used to evaluate the quality of organisation –citizen engagement, potentially providing a basis for informing actual models of democratic participation.”

The FDA is making adverse event and recall data available to app developers


in FierceBioTechIT: “When Beth Noveck arrived at the White House she had a clear, albeit unusual, mission–to apply the transparency and collaboration of the open-source movement to government. Noveck has now left the White House, but the ideas she brought are still percolating through the governmental machine. In 2014, the thinking is set to lead to a new, more open FDA.
Regulatory Focus reports the agency has quietly created a website and initiative called openFDA. At this stage the project is still in the prelaunch phase, but the FDA has already given a teaser of its plans. When the program opens for beta access later this year, users will gain access to structured data sets as application programming interfaces (APIs) and raw downloads. The ultimate scope of the project is unclear, but for now the FDA is working on making three data sets available.
The three data sets will give users unprecedented access to FDA archives of adverse events, product recalls and label information. Together the three data sets represent a substantial slice of what many people want to know about the FDA. The adverse event database contains details of millions of side effects and medication errors, while the recall information the FDA is preparing to share gathers all the public notices of products withdrawn from the market.
Making the data available as an API–a way for machines to talk to each other–means third parties can use the information as the basis for apps. The experience of the National Aeronautics and Space Administration (NASA) gives some indication of what might happen once the FDA opens up its data. One year after making its data available as an API in 2011, NASA began holding an annual Space Apps Challenge. At the event, people create apps and APIs.
Some challenges have no obvious use for NASA, such as a project to make a 3D printed model of the dark side of the moon from NASA data. Others could clearly be the starting point for technology used by the space agency. In one challenge, teams were tasked with creating a miniaturized modular research satellite for use on Mars. NASA is working to the same White House digital playbook as the FDA. How the FDA interprets the broad goals in the drug regulation arena remains to be seen.

Selected Readings on Behavioral Economics: Nudges


The Living Library’s Selected Readings series seeks to build a knowledge base on innovative approaches for improving the effectiveness and legitimacy of governance. This curated and annotated collection of recommended works on the topic of behavioral economics was originally published in 2014.

The 2008 publication of Richard Thaler and Cass Sunstein’s Nudge ushered in a new era of behavioral economics, and since then, policy makers in the United States and elsewhere have been applying behavioral economics to the field of public policy. Like Smart Disclosure, behavioral economics can be used in the public sector to improve the decisionmaking ability of citizens without relying on regulatory interventions. In the six years since Nudge was published, the United Kingdom has created the Behavioural Insights Team (also known as the Nudge Unit), a cross-ministerial organization that uses behavioral economics to inform public policy, and the White House has recently followed suit by convening a team of behavioral economists to create a behavioral insights-driven team in the United States. Policymakers have been using behavioral insights to design more effective interventions in the fields of long term unemployment; roadway safety; enrollment in retirement plans; and increasing enrollment in organ donation registries, to name some noteworthy examples. The literature of this nascent field provides a look at the growing optimism in the potential of applying behavioral insights in the public sector to improve people’s lives.

  • This paper examines the role default options play in pushing people toward making intelligent decisions regarding long-term savings and retirement planning.
  • Importantly, the authors provide evidence that a strategically oriented default setting from the outset is likely not enough to fully nudge people toward the best possible decisions in retirement savings. They find that the default settings in every major dimension of the savings process (from deciding whether to participate in a 401(k) to how to withdraw money at retirement) have real and distinct effects on behavior.

  • In this report, the United Kingdom’s Behavioural Insights Team does not attempt to “suggest that behaviour change techniques are the silver bullet that can solve every problem.” Rather, they explore a variety of examples where local authorities, charities, government and the private-sector are using behavioural interventions to encourage healthier behaviors.  
  • The report features case studies regarding behavioral insights ability to affect the following public health issues:

  • In this paper, Darling, Datta and Mullainathan outline the three most pervasive myths that abound within the literature about behavioral economics:
    • First, they dispel the relationship between control and behavioral economics.  Although tools used within behavioral economics can convince people to make certain choices, the goal is to nudge people to make the choices they want to make. For example, studies find that when retirement savings plans change the default to opt-in rather than opt-out, more workers set up 401K plans. This is an example of a nudge that guides people to make a choice that they already intend to make.
    • Second, they reiterate that the field is politically agnostic. Both liberals and conservatives have adopted behavioral economics and its approach is neither liberal nor conservative. President Obama embraces behavioral economics but the United Kingdom’s conservative party does, too.
    • And thirdly, the article highlights that irrationality actually has little to do with behavioral economics. Context is an important consideration when one considers what behavior is rational and what behavior is not. Rather than use the term “irrational” to describe human beings, the authors assert that humans are “infinitely complex” and behavior that is often considered irrational is entirely situational.

  • This paper explores the notion that being presented with a bevy of options can be desirable in many situations, but when making an intelligent decision requires a high-level understanding of the nuances of vastly different financial aid packages, for example, options can overwhelm. Heuristics (rules of thumb) provide helpful guidelines that “enable people to make ‘reasonably good’ decisions without needing to understand all the complex nuances of the situation.”
  • The underlying goal heuristics in the policy space involves giving people the type of “rules of thumb” that enable make good decisionmaking regarding complex topics such as finance, healthcare and education. The authors point to the benefit of asking individuals to remember smaller pieces of knowledge by referencing a series of studies conducted by psychologists Beatty and Kahneman that showed people were better able to remember long strings of numbers when they were broken into smaller segments.
  • Schoar and Datta recommend these four rules when implementing heuristics:
    • Use heuristics where possible, particularly in complex situation;
    • Leverage new technology (such as text messages and Internet-based tools) to implement heuristics.
    • Determine where heuristics can be used in adult training programs and replace in-depth training programs with heuristics where possible; and
    • Consider how to apply heuristics in situations where the exception is the rule. The authors point to the example of savings and credit card debt. In most instances, saving a portion of one’s income is a good rule of thumb. However, when one has high credit card debt, paying off debt could be preferable to building one’s savings.

  • This book, likely the single piece of scholarship most responsible for bringing the concept of nudges into the public consciousness, explores how a strategic “choice architecture” can help people make the best decisions.
  • Thaler and Sunstein, while advocating for the wider and more targeted use of nudges to help improve people’s lives without resorting to overly paternal regulation, look to five common nudges for lessons and inspiration:
    • The design of menus gets you to eat (and spend) more;
    • “Flies” in urinals improve, well, aim;
    • Credit card minimum payments affect repayment schedules;
    • Automatic savings programs increase savings rate; and
    • “Defaults” can improve rates of organ donation.
  • In the simplest terms, the authors propose the wider deployment of choice architectures that follow “the golden rule of libertarian paternalism: offer nudges that are most likely to help and least likely to inflict harm.”

  • This report from the U.K.’s Science and Technology Committee explores the government’s attempts to influence the behavior of its citizens through nudges, with a focus on comparing the effectiveness of nudges to that of regulatory interventions.
  • The author’s central conclusion is that, “non-regulatory measures used in isolation, including ‘nudges,’ are less likely to be effective. Effective policies often use a range of interventions.”
  • The report’s other major findings and recommendations are:
    • Government must invest in gathering more evidence about what measures work to influence population behaviour change;
    • They should appoint an independent Chief Social Scientist to provide them with robust and independent scientific advice;
    • The Government should take steps to implement a traffic light system of nutritional labelling on all food packaging; and
    • Current voluntary agreements with businesses in relation to public health have major failings. They are not a proportionate response to the scale of the problem of obesity and do not reflect the evidence about what will work to reduce obesity. If effective agreements cannot be reached, or if they show minimal benefit, the Government should pursue regulation.”

AskThem.io – Questions-and-Answers with Every Elected Official


Press Release: “AskThem.io, launching Feb. 10th, is a free & open-source website for questions-and-answers with public figures. AskThem is like a version of the White House’s “We The People” petition platform, where over 8 million people have taken action to support questions for a public response – but for the first time, for every elected official nationwide…AskThem.io has official government data for over 142,000 U.S. elected officials at every level of government: federal, state, county, and municipal. Also, AskThem allows anyone to ask a question to any verified Twitter account, for online dialogue with public figures.

Here’s how AskThem works for online public dialogue:

  • For the first time in an open-source website, visitors enter their street address to see all their elected officials, from federal down to the city levels, or search for a verified Twitter account.
  • Individuals & organizations submit a question to their elected officials – for example, asking a city council member about a proposed ban on plastic bags.
  • People then sign on to the questions and petitions they support, voting them up on AskThem and sharing them over social media, as with online petitions.
  • When a question passes a certain threshold of signatures, AskThem delivers it to the recipient over email & social media and encourages a public response – creating a continual, structured dialogue with elected officials at every level of government.

AskThem also incorporates open government data, such as city council agendas and key vote information, to inform good questions of people in power. Open government advocate, Chicago, IL Clerk Susana Mendoza, joined AskThem because she believes that “technology should bring residents and the Office of the Chicago City Clerk closer together.”

Elected officials who sign up with AskThem agree to respond to the most popular questions from their constituents (about two per month). Interested elected officials can sign up now to become verified, free & open to everyone.

Issue-based organizations can use question & petition info from AskThem to surface political issues in their area that people care about, stay continuously engaged with government, and promote public accountability. Participating groups on AskThem include the internet freedom non-profit Fight For the Future, the social media crowd-speaking platform Thunderclap.it, the Roosevelt Institute National Student Network, and more.”

Mind the Map: The Impact of Culture and Economic Affluence on Crowd-Mapping Behaviours


New paper by Dr. Licia Capra: “Crowd-mapping is a form of collaborative work that empowers citizens to collect and share geographic knowledge. Open-StreetMap (OSM) is a successful example of such paradigm, where the goal of building and maintaining an accurate global map of the changing world is being accomplished by means of local contributions made by over 1.2M citizens. While OSM has been subject to many country-specific studies, the relationship between national culture and economic affluence and users’ participation has been so far unexplored. In this work, we systematically study the link between them: we characterise OSM users in terms of who they are, how they contribute, during what period of time, and across what geographic areas. We find strong correlations between these characteristics and national culture factors (e.g., power distance, individualism, pace of life, self expression), and well as Gross Domestic Product per capita. Based on these findings, we discuss design issues that developers of crowd-mapping services should consider to account for cross-cultural differences”

Open data: Strategies for impact


Havey Lewis at Open Government Partnership Blog: “When someone used to talk about “data for good”, chances are they were wondering whether the open data stream they relied on was still going to be available in the future. Similarly, “good with data” meant that experienced data scientists were being sought for a deeply technical project. Both interpretations reflect a state of being rather than of doing: data being around for good; people being good with data.
Important though these considerations are, they miss what should be an obvious and more profound alternative.
Right now, organisations like DataKind™  and Periscopic, and many other entrepreneurs, innovators and established social enterprises that use open data, see things differently. They are using these straplines to shake up the status quo, to demonstrate that data-driven businesses can do well by doing good.
And it’s the confluence of the many national and international open data initiatives, and the growing number of technically able, socially responsible organisations that provide the opportunity for social as well as economic growth. The World Wide Web Foundation now estimates that there are over 370 open data initiatives around the world. Collectively, and through portals such as Quandl and and datacatalogs.org, these initiatives have made a staggering quantity of data available – in excess of eight million data sets. In addition, several successful and data-rich companies are entering into a new spirit of philanthropy – by donating their data for the public good. There’s no doubt that opening up data signals a new willingness by governments and businesses all over the world to engage with their citizens and customers in a new and more transparent way.
The challenge, though, is ensuring that these popular national and international open data initiatives are cohesive and impactful. And that the plans drawn up by public sector bodies to release specific data sets are based on the potential the data has to achieve a beneficial outcome, not – or, at least, not solely – based on the cost or ease of publication. Despite the best of intentions, only a relatively small proportion of open data sets now available has the latent potential to create significant economic or social impact. In our push to open up data and government, it seems that we may have fallen into the trap of believing the ends are the same as the means; that effect is the same as cause…”

The Age of ‘Infopolitics’


Colin Koopman in the New York Times: “We are in the midst of a flood of alarming revelations about information sweeps conducted by government agencies and private corporations concerning the activities and habits of ordinary Americans. After the initial alarm that accompanies every leak and news report, many of us retreat to the status quo, quieting ourselves with the thought that these new surveillance strategies are not all that sinister, especially if, as we like to say, we have nothing to hide.
One reason for our complacency is that we lack the intellectual framework to grasp the new kinds of political injustices characteristic of today’s information society. Everyone understands what is wrong with a government’s depriving its citizens of freedom of assembly or liberty of conscience. Everyone (or most everyone) understands the injustice of government-sanctioned racial profiling or policies that produce economic inequality along color lines. But though nearly all of us have a vague sense that something is wrong with the new regimes of data surveillance, it is difficult for us to specify exactly what is happening and why it raises serious concern, let alone what we might do about it.
Our confusion is a sign that we need a new way of thinking about our informational milieu. What we need is a concept of infopolitics that would help us understand the increasingly dense ties between politics and information. Infopolitics encompasses not only traditional state surveillance and data surveillance, but also “data analytics” (the techniques that enable marketers at companies like Target to detect, for instance, if you are pregnant), digital rights movements (promoted by organizations like the Electronic Frontier Foundation), online-only crypto-currencies (like Bitcoin or Litecoin), algorithmic finance (like automated micro-trading) and digital property disputes (from peer-to-peer file sharing to property claims in the virtual world of Second Life). These are only the tip of an enormous iceberg that is drifting we know not where.
Surveying this iceberg is crucial because atop it sits a new kind of person: the informational person. Politically and culturally, we are increasingly defined through an array of information architectures: highly designed environments of data, like our social media profiles, into which we often have to squeeze ourselves. The same is true of identity documents like your passport and individualizing dossiers like your college transcripts. Such architectures capture, code, sort, fasten and analyze a dizzying number of details about us. Our minds are represented by psychological evaluations, education records, credit scores. Our bodies are characterized via medical dossiers, fitness and nutrition tracking regimens, airport security apparatuses. We have become what the privacy theorist Daniel Solove calls “digital persons.” As such we are subject to infopolitics (or what the philosopher Grégoire Chamayou calls “datapower,” the political theorist Davide Panagia “datapolitik” and the pioneering thinker Donna Haraway “informatics of domination”).
Today’s informational person is the culmination of developments stretching back to the late 19th century. It was in those decades that a number of early technologies of informational identity were first assembled. Fingerprinting was implemented in colonial India, then imported to Britain, then exported worldwide. Anthropometry — the measurement of persons to produce identifying records — was developed in France in order to identify recidivists. The registration of births, which has since become profoundly important for initiating identification claims, became standardized in many countries, with Massachusetts pioneering the way in the United States before a census initiative in 1900 led to national standardization. In the same era, bureaucrats visiting rural districts complained that they could not identify individuals whose names changed from context to context, which led to initiatives to universalize standard names. Once fingerprints, biometrics, birth certificates and standardized names were operational, it became possible to implement an international passport system, a social security number and all other manner of paperwork that tells us who someone is. When all that paper ultimately went digital, the reams of data about us became radically more assessable and subject to manipulation, which has made us even more informational.
We like to think of ourselves as somehow apart from all this information. We are real — the information is merely about us. But what is it that is real? What would be left of you if someone took away all your numbers, cards, accounts, dossiers and other informational prostheses? Information is not just about you — it also constitutes who you are….”
