State Capabilities for Problem-Oriented Governance

As an approach to policy design and implementation, problem-oriented governance radically emphasizes the need for organizations to continuously learn and adapt. Scholars of public management, public administration, policy studies, international development, and political science have made important contributions to this problem-orientation turn; however, little systematic attention has been paid to the question of the state capabilities that underpin problem-oriented governance. In this article, we address this gap in the literature.

We argue that three core capabilities are structurally conducive to problem-oriented governance: a reflective-improvement capability, a collaborative capability, and a data-analytic capability. The article presents a conceptual framework for understanding each of these capabilities, including their chief constituent elements. Unregulated Health Research Using Mobile Devices: Ethical Considerations and Policy Recommendations

The Wisdom of the Market: Using Human Factors to Design Prediction Markets for Collective Intelligence

“Mind the Five”: Guidelines for Data Privacy and Security in Humanitarian Work With Undocumented Migrants and Other Vulnerable Populations

Small humanitarian organizations that help irregular migrants in the United States frequently do not have the resources or expertise to fully address the implications of collecting, storing, and using data about the vulnerable populations they serve. As a result, there is a risk that their work could exacerbate the vulnerabilities of the very same migrants they are trying to help. In this study, we propose a conceptual framework for protecting privacy in the context of humanitarian information activities (HIA) with irregular migrants. We draw from a review of the academic literature as well as interviews with individuals affiliated with several US‐based humanitarian organizations, higher education institutions, and nonprofit organizations that provide support to undocumented migrants. We discuss 3 primary issues: (i) HIA present both technological and human risks; (ii) the expectation of privacy self‐management by vulnerable populations is problematic; and (iii) there is a need for robust, actionable, privacy‐related guidelines for HIA. Principles alone cannot guarantee ethical AI


Paper by Brent Mittelstadt: “Artificial intelligence (AI) ethics is now a global topic of discussion in academic and policy circles. At least 84 public–private initiatives have produced statements describing high-level principles, values and other tenets to guide the ethical development, deployment and governance of AI. According to recent meta-analyses, AI ethics has seemingly converged on a set of principles that closely resemble the four classic principles of medical ethics. Despite the initial credibility granted to a principled approach to AI ethics by the connection to principles in medical ethics, there are reasons to be concerned about its future impact on AI development and governance. Significant differences exist between medicine and AI development that suggest a principled approach for the latter may not enjoy success comparable to the former. Compared to medicine, AI development lacks (1) common aims and fiduciary duties, (2) professional history and norms, (3) proven methods to translate principles into practice, and (4) robust legal and professional accountability mechanisms. These differences suggest we should not yet celebrate consensus around high-level principles that hide deep political and normative disagreement….(More)”.

New Site and Report by UNICEF and The GovLab: “RD4C seeks to build awareness regarding the need for special attention to data issues affecting children—especially in this age of changing technology and data linkage; and to engage with governments, communities, and development actors to put the best interests of children and a child rights approach at the center of our data activities. The right data in the right hands at the right time can significantly improve outcomes for children. The challenge is to understand the potential risks and ensure that the collection, analysis and use of data on children does not undermine these benefits.

Drawing upon field-based research and established good practice, RD4C aims to highlight and support best practice data responsibility; identify challenges and develop practical tools to assist practitioners in evaluating and addressing them; and encourage a broader discussion on actionable principles, insights, and approaches for responsible data management.

Uses and Reuses of Scientific Data: The Data Creators’ Advantage

Wofford: “Open access to data, as a core principle of open science, is predicated on assumptions that scientific data can be reused by other researchers. We test those assumptions by asking where scientists find reusable data, how they reuse those data, and how they interpret data they did not collect themselves. By conducting a qualitative meta-analysis of evidence on two long-term, distributed, interdisciplinary consortia, we found that scientists frequently sought data from public collections and from other researchers for comparative purposes such as “ground-truthing” and calibration. When they sought others’ data for reanalysis or for combining with their own data, which was relatively rare, most preferred to collaborate with the data creators.

We propose a typology of data reuses ranging from comparative to integrative. Comparative data reuse requires interactional expertise, which involves knowing enough about the data to assess their quality and value for a specific comparison such as calibrating an instrument in a lab experiment. Integrative reuse requires contributory expertise, which involves the ability to perform the action, such as reusing data in a new experiment. Data integration requires more specialized scientific knowledge and deeper levels of epistemic trust in the knowledge products. Metadata, ontologies, and other forms of curation benefit interpretation for any kind of data reuse. Based on these findings, we theorize the data creators’ advantage, that those who create data have intimate and tacit knowledge that can be used as barter to form collaborations for mutual advantage. The Impact of Open Data on Public Procurement


Paper by Raphael Duguay, Thomas Rauter and Delphine Samuels: “We examine how the increased accessibility of public purchasing data affects competition, prices, contract allocations, and contract performance in government procurement. The European Union recently made its already public but difficult-to-access information about the process and outcomes of procurement awards available for bulk download in a user-friendly format.

Comparing government contracts above EU publication thresholds with contracts that are not, we find that increasing the public accessibility of procurement data raises the likelihood of having competitive bidding processes, increases the number of bids per contract, and facilitates market entry by new vendors. Following the open data initiative, procurement prices decrease and EU government agencies are more likely to award contracts to the lowest bidder.

However, the increased competition comes at a cost ─ firms execute government contracts with more delays and ex-post price renegotiations. These effects are stronger for new vendors, complex procurement projects, and contracts awarded solely based on price. Overall, our results suggest that open procurement data facilitates competition and lowers ex-ante procurement prices but does not necessarily increase allocative efficiency in government contracting….(More)”.

Human Capital and Administrative Burden: The Role of Cognitive Resources in Citizen-State Interactions


Paper by Julian Christensen et al: “One means by which the state reinforces inequality is by imposing administrative burdens that loom larger for citizens with lower levels of human capital. Integrating insights from various disciplines, we focus on one aspect of human capital, cognitive resources. We outline a model that explains how burdens and cognitive resources, especially executive functioning, interrelate. We then provide illustrative examples, by highlighting three common life factors – scarcity, health problems, and age-related cognitive decline. These factors create a human capital Catch-22, increasing people’s likelihood of needing state assistance while simultaneously undermining the cognitive resources required to negotiate the burdens they encounter while seeking such assistance. The result is to reduce access to state benefits and increase inequality.
