Data Discrimination Means the Poor May Experience a Different Internet


MIT Technology Review: “Data analytics are being used to implement a subtle form of discrimination, while anonymous data sets can be mined to reveal health data and other private information, a Microsoft researcher warned this morning at MIT Technology Review’s EmTech conference.
Kate Crawford, principal researcher at Microsoft Research, argued that these problems could be addressed with new legal approaches to the use of personal data.
In a new paper, she and a colleague propose a system of “due process” that would give people more legal rights to understand how data analytics are used in determinations made against them, such as denial of health insurance or a job. “It’s the very start of a conversation about how to do this better,” Crawford, who is also a visiting professor at the MIT Center for Civic Media, said in an interview before the event. “People think ‘big data’ avoids the problem of discrimination, because you are dealing with big data sets, but in fact big data is being used for more and more precise forms of discrimination—a form of data redlining.”
During her talk this morning, Crawford added that with big data, “you will never know what those discriminations are, and I think that’s where the concern begins.”

More Top-Down Participation, Please! Institutionalized empowerment through open participation

Quite the contrary: It instead seeks to stress the empowering potential of top-down digital political participation. Strikingly, the democratic institutionalization of (digital) political participation is rarely considered when we speak about power in the context of political participation. Wouldn’t it be true empowerment though if the right of citizens to speak their minds were directly integrated into political and administrative decision-making processes?

Institutionalized political participation

Political participation, defined as any act that aims to influence politics in some way, can be initiated either by citizens, referred to as “bottom-up” participation, or by government, often referred to as “top-down” participation.  For many, the word “top-down” instantly evokes negative connotations, even though top-down participatory spaces are actually the foundation of democracy. These are the spaces of participation offered by the state and guaranteed by democratic constitutions. For a long time, top-down participation could be equated with formal democratic participation such as elections, referenda or party politics. Today, however, in states like Germany we can observe a new form of top-down political participation, namely government-initiated participation that goes beyond what is legally required and usually makes extensive use of digital media.
Like many other Western states, Germany has to cope with decreasing voter turnout and a lack of trust in political parties. At the same time, according to a recent study from 2012, two-thirds of eligible voters would like to be more involved in political decisions. The case of “Stuttgart 21” served as a late wake-up call for many German municipalities. Plans to construct a new train station in the center of the city of Stuttgart resulted in a petition for a local referendum, which was rejected. Protests against the train station culminated in widespread demonstrations in 2010, forcing construction to be halted. Even though a referendum was finally held in 2011 and a slight majority voted in favor of the train station, the Stuttgart 21 case has since been cited by Chancellor Angela Merkel and others as an example of the negative consequences of taking decisions without consulting with citizens early on. More and more municipalities and federal ministries in Germany have therefore started acknowledging that the conventional democratic model of participation in elections every few years is no longer sufficient. The Federal Ministry of Transport, Building and Urban Development, for example, published a manual for “good participation” in urban development projects….

What’s so great about top-down participation?

Semi-formal top-down participation processes have one major thing in common, regardless of the topic they address: Governmental institutions voluntarily open up a space for dialogue and thereby obligate themselves to take citizens’ concerns and ideas into account.
As a consequence, government-initiated participation offers the potential for institutionalized empowerment beyond elections. It grants the possibility of integrating participation into political and administrative decision-making processes….
Bottom-up participation will surely always be an important mobilizer of democratic change. Nevertheless, the provision of spaces of open participation by governments can aid in the institutionalization of citizens’ involvement in political decision-making. Had Stuttgart offered an open space of participation early in the train station construction process, maybe protests would never have escalated the way they did.
So is top-down participation the next step in the process of democratization? It could be, but only under certain conditions. Most importantly, top-down open participation requires a genuine willingness to abandon the old principle of doing business behind closed doors. This is not an easy undertaking; it requires time and endurance. Serious open participation also requires creating state institutions that ensure the relevance of the results by evaluating them and considering them in political decisions. We have formulated ten conditions that we consider necessary for the genuine institutionalization of open political participation [14]:

  • There needs to be some scope for decision-making. Top-down participation only makes sense when the results of the participation can influence decisions.
  • The government must genuinely aim to integrate the results into decision-making processes.
  • The limits of participation must be communicated clearly. Citizens must be informed if final decision-making power rests with a political body, for example.
  • The subject matter, rules and procedures need to be transparent.
  • Citizens need to be aware that they have the opportunity to participate.
  • Access to participation must be easy, the channels of participation chosen according to the citizens’ media habits. Using the Internet should not be a goal in itself.
  • The participatory space should be “neutral ground”. A moderator can help ensure this.
  • The set-up must be interactive. Providing information is only a prerequisite for participation.
  • Participation must be possible without providing real names or personal data.
  • Citizens must receive continuous feedback regarding how results are handled and the implementation process.”

The Value of Personal Data


The Digital Enlightenment Yearbook 2013 is dedicated this year to Personal Data:  “The value of personal data has traditionally been understood in ethical terms as a safeguard for personality rights such as human dignity and privacy. However, we have entered an era where personal data are mined, traded and monetized in the process of creating added value – often in terms of free services including efficient search, support for social networking and personalized communications. This volume investigates whether the economic value of personal data can be realized without compromising privacy, fairness and contextual integrity. It brings scholars and scientists from the disciplines of computer science, law and social science together with policymakers, engineers and entrepreneurs with practical experience of implementing personal data management.
The resulting collection will be of interest to anyone concerned about privacy in our digital age, especially those working in the field of personal information management, whether academics, policymakers, or those working in the private sector.”

OECD's Revised Guidelines on Privacy


OECD: “Over many decades the OECD has played an important role in promoting respect for privacy as a fundamental value and a condition for the free flow of personal data across borders. The cornerstone of OECD work on privacy is its newly revised Guidelines on the Protection of Privacy and Transborder Flows of Personal Data (2013).
Another key component of work in this area aims to improve cross-border co-operation among privacy law enforcement authorities.  This work produced an OECD Recommendation on Cross-border Co-operation in the Enforcement of Laws Protecting Privacy in 2007 and inspired the formation of the Global Privacy Enforcement Network, to which the OECD provides support.
Other projects have examined privacy notices and considered privacy in the context of horizontal issues such as radio frequency indentification (RFID), digital identity management, and looked at metrics to inform policy making in these areas. The important role of privacy is also addressed in the OECD Recommendation on Principles for Internet Policy Making (2011) and the Seoul Ministerial Declaration on the Future of the Internet Economy (2008).
Current work is examining privacy-related issues raised by large-scale data use and analytics. It is part of a broader project on the data-driven innovation and growth, which already produced a preliminary report identifying key issues.”

Taking Games for Good to a New Level


Idit Harel Caperton (@idit) in SSIR: “Last month’s Games for Change Festival (G4C) celebrated the promising power of video games to yield social change. The event, now in its tenth year, brings game developers, educators, NGOs, and government agencies to New York City to discuss and promote the creation of social-issue games in an industry with a global market of $67 billion, projected to reach $82 billion by 2017. Big numbers like this prove that the gaming industry has engaged the masses, and G4C wants to push this engagement toward social learning and positive action.
It’s already happening on a small scale. The Games for Change Awards, announced annually at the festival, recognizes effective mission-driven games. This year’s winning games included “Data Dealer,” which raises awareness around personal data and online privacy, and “Quandary,” where players are social pioneers facing decisions that challenge their moral compass. These and other games endorsed at G4C achieve a blend of social influence and technical innovation through engaging gameplay.
G4C has also aligned with larger social impact movements, proving that video games can be vehicles for positive global action through game mechanics. Half the Sky Movement is a transmedia campaign working against the oppression of women worldwide; it includes a book, film, and game. The game, produced by G4C and available for free on Facebook, features game tasks that transfer to real-world donations and social action opportunities. Since launching in March, “Half the Sky Movement: The Game” has raised nearly $350,000 to empower women worldwide. Yet, social issue games production still resides on the edge of the gaming industry. …”

Information Consumerism – The Price of Hypocrisy


Evgeny Morozov in Frankfurter Algemeine: “What we need is a sharper, starker picture of the information apocalypse that awaits us in a world where personal data is traded like coffee or any other commodity. Take the oft-repeated argument about the benefits of trading one’s data in exchange for some tangible commercial benefit. Say, for example, you install a sensor in your car to prove to your insurance company that you are driving much safer than the average driver that figures in their model for pricing insurance policies. Great: if you are better than the average, you get to pay less. But the problem with averages is that half of the population is always worse than the benchmark. Inevitably –regardless of whether they want to monitor themselves or not – that other half will be forced to pay more, for as the more successful of us take on self-tracking, most social institutions would (quite logically) assume that those who refuse to self-track have something to hide. Under this model, the implications of my decision to trade my personal data are no longer solely in the realm of markets and economics – they are also in the realm of ethics. If my decision to share my personal data for a quick buck makes someone else worse off and deprives them of opportunities, then I have an extra ethical factor to consider – economics alone doesn’t suffice.
All of this is to say that there are profound political and moral consequences to information consumerism– and they are comparable to energy consumerism in scope and importance. Making these consequences more pronounced and vivid is where intellectuals and political parties ought to focus their efforts. We should do our best to suspend the seeming economic normalcy of information sharing. An attitude of “just business!” will no longer suffice. Information sharing might have a vibrant market around it but it has no ethical framework to back it up. More than three decades ago, Michel Foucault was prescient to see that neoliberalism would turns us all into “entrepreneurs of the self” but let’s not forget that entrepreneurship is not without its downsides: as most economic activities, it can generate negative externalities, from pollution to noise. Entrepreneurship focused on information sharing is no exception….”

I spend hours every day surfing the internet. Meanwhile, companies like Facebook and Google have been using my online information (the websites I visit, the friends I have, the videos I watch) for their own benefit.
In 2012, advertising revenue in the United States was around $30 billion. That same year, I made exactly $0 from my own data. But what if I tracked everything myself? Could I at least make a couple bucks back?
I started looking at the terms of service for the websites I often use. In their privacy policies, I have found sentences like this: “You grant a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such content in any and all media or distribution methods (now known or later developed).” I’ve basically agreed to give away a lifelong, international, sub-licensable right to use my personal data….

Intel Fuels a Rebellion Around Your Data


we the dataAntonio Regalado and Jessica Leber in MIT Technology Review:”Intel Labs, the company’s R&D arm, is launching an initiative around what it calls the “data economy”—how consumers might capture more of the value of their personal information, like digital records of their their location or work history. To make this possible, Intel is funding hackathons to urge developers to explore novel uses of personal data. It has also paid for a rebellious-sounding website called We the Data, featuring raised fists and stories comparing Facebook to Exxon Mobil.
Intel’s effort to stir a debate around “your data” is just one example of how some companies—and society more broadly—are grappling with a basic economic asymmetry of the big data age: they’ve got the data, and we don’t.
